The FAA may take enforcement action against anyone who conducts an unauthorized UAS operation or operates a UAS in a way that endangers the safety of the national airspace system. This authority is designed to protect users of the airspace as well as people and property on the ground.

Can the FAA make laws?

First of all, the FAA can’t make laws – only develop guidelines and regulations. The federal government has no authority whatsoever to regulate the operation of remote-controlled model aircraft.

Can pilots fly drones?

To earn a drone license, a drone pilot must satisfy a few qualifications, be vetted by the TSA, and pass a 60-item Part 107 knowledge test. This imposes a minimum level of proficiency for all commercial drone pilots and ensures that all of them know the restrictions and procedures required by Part 107.

What is a Category 2 drone?

To operate in Category 2, drones can weigh more than 0.55 pounds, but they can’t be capable of causing injury to a human being that is greater than or equal to the severity of an injury caused by transferring 11 foot-pounds of kinetic energy.

Do all drones need to be registered with the FAA?

All drones must be registered, except those that weigh 0.55 pounds or less (less than 250 grams) and are flown exclusively under the Exception for Recreational Flyers.

Does the FAA follow the far?

Nearly every federal agency is required to follow the Federal Acquisition Regulation (“FAR”). However, one exception is the Federal Aviation Administration (“FAA”), which is not required to comply with the FAR but rather has its own policies and procedures, called the Acquisition Management System (“AMS”).

What is a Category 4 UAS?

Finally, Category 4 allows small UAVs under part 21 to operate over people, so long as the operating limitations specified in the approved Flight Manual or as otherwise specified by the Administrator, do not prohibit operations over people.

What happens if you don’t register your drone with the FAA?

Failure to register a drone that requires registration may result in regulatory and criminal penalties. The FAA may assess civil penalties up to $27,500. Criminal penalties include fines of up to $250,000 and/or imprisonment for up to three (3) years.

Which agencies are not subject to the FAR?

The FAR does not apply to legislative branch agencies or judicial branch agencies, although agencies in the other branches of government (or otherwise not subject to the FAR) may adopt the FAR as a matter of policy, or promulgate or otherwise be subject to requirements like those in the FAR.
